CONTRATO DE CONSENTIMIENTO PARA EL ENV\u00cdO DE MENSAJES SMS<\/strong><\/p>\n

Este contrato de consentimiento (en adelante, el \u00abContrato\u00bb) se celebra entre: Enterprise Solutions Accounting, con domicilio en 3048 S. Broad St., Hamilton, NJ 08610, representada por Henry Pulido, en su calidad de Presidente, en adelante denominada \u00abLA EMPRESA\u00bb; y EL CLIENTE, cuyos datos de identificaci\u00f3n y domicilio ser\u00e1n completados al momento de la firma del presente contrato, en adelante denominado \u00abEL CLIENTE\u00bb.
Las partes acuerdan lo siguiente:<\/p>\n


1. OBJETO DEL CONTRATO<\/b><\/p>\n


<\/b>EL CLIENTE otorga su consentimiento expreso y voluntario a LA EMPRESA para el env\u00edo de mensajes de texto (SMS) a su n\u00famero de tel\u00e9fono con el prop\u00f3sito de recibir informaci\u00f3n relevante, incluyendo, pero no limitado a:
<\/p>\n

    \n
  •  Promociones y ofertas especiales.<\/li>\n
  •  Recordatorios de citas o servicios.<\/li>\n
  •  Informaci\u00f3n sobre productos y servicios.<\/li>\n
  •  Notificaciones de seguridad o alertas importantes.<\/li>\n
  •  Comunicaciones relacionadas con transacciones o gestiones administrativas.<\/li>\n

  • <\/li>\n<\/ul>\n

    2. CONSENTIMIENTO Y ACEPTACI\u00d3N<\/b><\/p>\n


    <\/b>2.1. EL CLIENTE declara que ha sido informado de manera clara y suficiente sobre el prop\u00f3sito del env\u00edo de SMS y otorga su consentimiento expreso y voluntario para recibir dichas comunicaciones.
    2.2. EL CLIENTE reconoce que la recepci\u00f3n de los mensajes puede implicar costos adicionales dependiendo del plan de su proveedor de telefon\u00eda m\u00f3vil y que LA EMPRESA no se hace responsable de dichos costos.
    2.3. EL CLIENTE manifiesta que es titular o usuario autorizado del n\u00famero de tel\u00e9fono proporcionado y que tiene la capacidad legal para otorgar el presente consentimiento.
    2.4. EL CLIENTE reconoce que el consentimiento no es una condici\u00f3n para la compra de bienes o servicios.
    3. DERECHOS DEL CLIENTE
    <\/b>3.1. EL CLIENTE tiene el derecho de revocar en cualquier momento su consentimiento
    para la recepci\u00f3n de SMS enviando una solicitud a LA EMPRESA a trav\u00e9s de los
    siguientes medios:
    \u2022 Enviando un mensaje con la palabra \u00abSTOP\u00bb al n\u00famero indicado en los mensajes
    recibidos.
    \u2022 Contactando al servicio de atenci\u00f3n al cliente en info@epsaccounting.com<\/p>

    3.2. Una vez recibida la solicitud de revocaci\u00f3n, LA EMPRESA cesar\u00e1 el env\u00edo de
    mensajes SMS en un plazo m\u00e1ximo de 10 d\u00edas h\u00e1biles.
    3.3. EL CLIENTE puede solicitar informaci\u00f3n sobre los mensajes enviados respondiendo
    con la palabra \u00abHELP\u00bb.<\/p>


    4. POL\u00cdTICA DE PRIVACIDAD Y PROTECCI\u00d3N DE DATOS<\/b><\/p>


    <\/b>4.1. LA EMPRESA se compromete a tratar los datos personales de EL CLIENTE conforme
    a lo establecido en la Ley de Protecci\u00f3n de la Privacidad del Consumidor de EE.UU. y
    otras regulaciones aplicables, como la Ley de Protecci\u00f3n del Consumidor Telef\u00f3nico
    (TCPA) y la Ley de Privacidad del Consumidor de California (CCPA).
    4.2. Los datos proporcionados por EL CLIENTE ser\u00e1n utilizados exclusivamente para los
    fines indicados en este Contrato y no ser\u00e1n compartidos con terceros sin su
    autorizaci\u00f3n expresa, salvo requerimiento legal.
    5. VIGENCIA Y MODIFICACI\u00d3N
    <\/b>5.1. El presente Contrato entrar\u00e1 en vigor a partir de la fecha de firma y permanecer\u00e1
    vigente hasta que EL CLIENTE revoque su consentimiento o LA EMPRESA deje de
    prestar el servicio de env\u00edo de SMS.
    5.2. LA EMPRESA se reserva el derecho de modificar las condiciones del presente
    Contrato, notificando previamente a EL CLIENTE con 30 d\u00edas de anticipaci\u00f3n. En caso de
    no aceptar las modificaciones, EL CLIENTE podr\u00e1 revocar su consentimiento de acuerdo
    con la cl\u00e1usula 3.
    6. LEGISLACI\u00d3N APLICABLE Y JURISDICCI\u00d3N
    <\/b>6.1. Este Contrato se regir\u00e1 por las leyes del Estado de New Jersey y cualquier
    controversia derivada del mismo ser\u00e1 resuelta ante los tribunales competentes de
    Hamilton, NJ.
    6.2. EL CLIENTE reconoce y acepta que este es un contrato digital, y al marcar la casilla
    de aceptaci\u00f3n en el formulario correspondiente, expresa su consentimiento expreso y
    voluntario, teniendo la misma validez legal que una firma manuscrita.
    6.3. EL CLIENTE reconoce haber le\u00eddo, comprendido y aceptado los t\u00e9rminos y
